1. Definitions

• “Company”, “we”, “us” or “our” means BAYZONS PRIVATE LIMITED, CIN U46498MH2026PTC470353, having its registered office at Unit No. A-203, 204, Kotia Nirman Commercial, Andheri, Mumbai, Maharashtra 400053, India.
• “Website” means bayzonstores.online, including all pages, sub-domains and services offered through it.
• “User”, “you” or “your” means any person who accesses the Website, whether or not they place an order.
• “Products” means seeds, saplings, live plants and allied agricultural inputs listed for sale on the Website.
• “Order” means a request submitted by you through the Website to purchase one or more Products.

2. Eligibility to use the Website

You must be at least 18 years of age and legally competent to contract under the Indian Contract Act, 1872 to place an order on the Website. If you are under 18, you may use the Website only under the supervision of a parent or legal guardian who accepts these Terms on your behalf.

By placing an order you confirm that the contact, billing and delivery information you provide is accurate, complete and belongs to you or to a person who has authorised you to use it.

3. Products, descriptions and availability

We take reasonable care to describe every Product accurately, including pack size, variety and price. Product photographs are indicative. Natural agricultural produce varies in size, colour and appearance, and the item delivered may differ visually from the photograph shown.

Seeds are living biological material. Germination depends on soil, climate, water, storage and sowing practice, all of which are outside our control. We state the pack size and variety accurately but we do not and cannot guarantee a specific germination rate, yield or crop outcome.

• All Products are subject to availability. We may withdraw or modify any listing at any time.
• Where a Product becomes unavailable after you have paid, we will cancel that line item and refund it in full.
• We reserve the right to limit the quantity of any Product sold to a single customer or address.

4. Pricing

All prices on the Website are quoted in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax unless stated otherwise on the product page. The price payable is the price displayed on the Website at the moment your order is confirmed.

Shipping is free on all prepaid orders. Cash on Delivery orders carry a flat handling charge of ₹50, which is shown separately in the order summary before you confirm payment.

• We may change prices at any time. A price change does not affect an order that has already been confirmed.
• If a Product is listed at a manifestly incorrect price due to a technical or human error, we may cancel the order and refund any amount paid in full. We will inform you before doing so.

5. Orders and formation of contract

Your submission of an order is an offer to purchase. Our acknowledgement of your order is not an acceptance. A binding contract is formed only when we confirm dispatch of the Product to you.

We may decline or cancel any order, in whole or in part, where we reasonably believe that the order is fraudulent, that the delivery address is not serviceable, that the Product is unavailable, that pricing was incorrect, or that the order breaches these Terms. Where you have already paid, we will refund the affected amount in full.

6. Payment

Payments on the Website are processed by a third-party payment gateway that is PCI-DSS compliant. We accept UPI, credit and debit cards, net banking, wallets and, where enabled, Cash on Delivery.

We do not receive, store or process your full card number, CVV or online banking credentials. Those details are captured directly by the payment gateway on its own secure infrastructure.

• If an amount is debited but your order does not confirm, the amount is normally reversed automatically by your bank within 5 to 7 working days.
• Cash on Delivery is available on orders up to ₹20,000 and only at serviceable pin codes.
• You are responsible for any bank charge, currency conversion cost or transaction fee levied by your own bank or card issuer.

7. Shipping and delivery

Delivery timelines, dispatch windows and serviceability are set out in our Shipping & Delivery Policy, which forms part of these Terms. Estimated timelines are indicative and are not guaranteed delivery dates. Delays caused by courier networks, weather, strikes, regional restrictions or other events outside our control do not constitute a breach of these Terms.

8. Returns, cancellations and refunds

Your rights to cancel an order, return a Product and obtain a refund are set out in our Cancellation Policy and our Returns & Refund Policy. Both form part of these Terms. Please read them before you place an order, particularly the provisions on perishable and living Products.

9. Accounts and account security

Creating an account is optional. You may complete a purchase as a guest. If you do create an account, you are responsible for keeping your password confidential and for all activity that takes place under your account.

You must notify us immediately at support@bayzonstores.online if you believe your account has been accessed without your authorisation. We may suspend or terminate any account that we reasonably believe is being used fraudulently or in breach of these Terms.

10. Acceptable use

You agree that you will not:

• use the Website for any unlawful purpose or in breach of any applicable Indian law or regulation;
• place speculative, false or fraudulent orders, or use another person's payment instrument without authority;
• attempt to gain unauthorised access to the Website, its servers, or any data held on them;
• introduce any virus, malware, or other harmful code to the Website;
• scrape, copy, republish or commercially exploit any content from the Website without our written consent;
• resell Products obtained through the Website in a manner that misrepresents their origin or our brand.

11. Intellectual property

All content on the Website — including the Bayzons name and logo, text, product descriptions, graphics, photographs, page layout and software — is owned by or licensed to BAYZONS PRIVATE LIMITED and is protected by Indian and international intellectual property law. You may view and print content for your own personal, non-commercial use. Any other use requires our prior written permission.

12. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability to you in connection with any order is limited to the amount you actually paid for that order.

We are not liable for indirect, incidental, special or consequential loss, including loss of crop, loss of yield, loss of profit, loss of business or loss of expected savings, however arising. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, or for fraud.

13. Indemnity

You agree to indemnify and hold harmless BAYZONS PRIVATE LIMITED, its directors, officers and employees against any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Website, or your violation of any law or the rights of any third party.

14. Force majeure

We are not liable for any failure or delay in performing our obligations where that failure or delay results from an event beyond our reasonable control, including act of God, flood, drought, earthquake, epidemic or pandemic, war, civil unrest, terrorism, strike, failure of public infrastructure or telecommunications, courier network failure, or any government order or restriction.

15. Third-party links

The Website may contain links to third-party websites, including our payment gateway and courier partners. We do not control those websites and are not responsible for their content, security or privacy practices. Accessing them is at your own risk and subject to their own terms.

16. Changes to these Terms

We may revise these Terms at any time. The revised version takes effect from the date it is published on this page, shown as the “Last updated” date above. Orders are governed by the version of the Terms in force at the time the order was placed. Please review this page periodically.

17. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to the grievance redressal process set out in our Contact page, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

18. Grievance redressal

In accordance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, complaints may be addressed to our Nodal Grievance Officer at grievance@bayzonstores.online. We acknowledge every complaint within 48 hours and work to resolve it within 30 days of receipt. Full details are on our Contact page.
